"The question to be decided was, whether the copper ore raised from mines in conventionary tenements in Tewington was the property of his Majesty, in right of his Duchy of Cornwall, or of the conventionary tenants ... the claim of the plaintiff, who was the conventionary tenant, to the minerals under his tenement, was founded upon the position, that he had a freehold interest in his tenement, or what was equivalent thereto; and that such interest carried with it the absolute right to the soil"--Page x |
