Summary |
In the Engineers Case in 1920, the High Court held that the Commonwealth could make laws binding on the states under its "conciliation and arbitration" power. In an ambiguous and poorly structured judgment, the majority emphasised reliance upon the text of the Constitution over implications derived from external sources that might protect state power. Deeply influential, and almost equally controversial, the appropriateness of this approach today is considered in the light of recent landmark High Court decisions |
